1. Introduction

Welcome to Boston Systems Consulting ("BSC," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, platform, and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of our services complies with all applicable laws and regulations.

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you meet this age requirement.

3. Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. All Sales Final

All purchases of precious metals through our platform are final. There are no returns, no refunds, and no exchanges. Purchasing precious metals is comparable to purchasing a security on the open market -- you may sell your holdings on the open market, but you cannot return them to us.

Prices are locked at the time of purchase. Subsequent movement in spot prices or market conditions is not grounds for a return, refund, cancellation, or dispute of any kind.

5. Chargebacks, Returns, and Payment Disputes

If a buyer initiates a return, chargeback, payment reversal, or any other payment dispute, the buyer agrees to be fully responsible for all costs incurred by BSC in recovering the amounts owed. These costs include, but are not limited to:

• Employee and personnel time, billed at up to $2,000 per hour for senior personnel involved in dispute resolution
• All legal fees, collection agency fees, and court costs
• Shipping, logistics, and insurance costs associated with the disputed transaction
• Administrative fees related to processing and resolving the dispute
• Market losses incurred during the dispute period, including any difference between the original sale price and the current market value
• Bank fees, chargeback fees, and payment processor penalties

By completing a purchase, you acknowledge and agree to these terms. We reserve the right to pursue all available legal remedies to recover amounts owed.

6. Payment Services

In order to use the payment functionality of our application, you must open a "Dwolla Account" provided by Dwolla, Inc. and you must accept the Dwolla Terms of Service and Privacy Policy. Any funds held in or transferred through your Dwolla Account are held or transferred by Dwolla's financial institution partners. You must be at least 18 years old to create a Dwolla Account.

You authorize us to collect and share with Dwolla your personal information including full name, date of birth, social security number, physical address, email address and financial information, and you are responsible for the accuracy and completeness of that data.

You understand that you will access and manage your Dwolla Account through our application, and Dwolla account notifications will be sent by us, not Dwolla. We will provide customer support for your Dwolla Account activity, and can be reached at bostonsystemsconsulting.com/contact and info@bostonsystemsconsulting.com.

7. Identity Verification

We may require identity verification for orders above certain thresholds or when otherwise required by applicable law or our internal compliance policies. By using our services, you consent to third-party identity verification and agree to provide accurate and complete information when requested.

Failure to complete identity verification when required may result in order cancellation, account suspension, or restriction of services.

8. Pricing and Availability

All prices are subject to change without notice and are based on current market conditions at the time of purchase. While we make every effort to ensure accuracy, we reserve the right to cancel or refuse any order where pricing errors, system malfunctions, or suspected fraudulent activity are identified.

Product availability is not guaranteed. We may limit quantities or discontinue products at any time without prior notice.

9. Shipping and Delivery

Risk of loss and title for items purchased pass to the carrier at the time of tender. We are not responsible for loss, theft, or damage to shipments once they have been transferred to the shipping carrier. We recommend purchasing shipping insurance for all orders.

10. Intellectual Property

All content, features, and functionality of our services -- including but not limited to text, graphics, logos, and software -- are the exclusive property of Boston Systems Consulting and are protected by copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

To the fullest extent permitted by law, Boston Systems Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

12. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

We may terminate or suspend your access to our services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will immediately cease. Any outstanding obligations, including payment obligations, shall survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable federal and state laws, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the new Terms.
